Terms of Service

Overview

This website is operated by colorly.ai, from Canada. Throughout the site, the terms "we", "us" and "our" refer to colorly.ai. We offer this website and its tools for making AI-generated coloring pages and books (the "Service") to you, the user, on the condition that you accept these Terms of Service ("Terms") and the policies they refer to, including our Privacy Policy and Refund Policy.

By visiting the site, creating an account or buying credits, you agree to these Terms. They apply to all users, including visitors and customers. If you don't agree, you may not use the Service. New features and tools are also covered by these Terms.

Who can use the Service

You must be at least 18 and the age of majority where you live to create an account or buy credits. Adults are welcome to make pages and books for children, but children shouldn't hold accounts or use the Service directly.

Your account

You sign in with Google. You're responsible for what happens under your account, so keep your Google login secure and tell us if you think someone else has access.

General conditions

• We may refuse service to anyone, where the law allows.
• You must not copy, sell, resell or exploit the Service or access to it without our written permission. This doesn't restrict your use of the images you generate, which is covered below.

Credits and payment

• Credit packs are one-time purchases, not subscriptions. Stripe processes all payments.
• One credit makes one coloring page. A coloring book uses one credit per page, including the cover.
• Free credits reset each month, don't roll over and are used before purchased credits.
• Purchased credits don't expire while your account and the Service remain active.
• Credits have no cash value and can't be transferred or resold.
• Refunds are covered by our Refund Policy. If a drawing fails to generate, its credit is returned automatically.
• Prices and what a credit buys may change without notice, but a change won't affect credits you've already bought. We may refuse or limit a purchase, or correct a pricing error, including after you've ordered. If we cancel a purchase, we'll refund it.
• Please keep your account email and payment details accurate, so we can complete your purchase and contact you.

Generated images and your content

You keep your rights in the prompts you write. As between you and us, you may use the images and books you generate, and we assign to you whatever rights we have in them.

The law on AI-generated content is still developing, so those images may not qualify for copyright protection, and similar images could be generated for other people. We don't promise that an image is free of third-party rights, and you're responsible for how you use it, especially if it resembles an existing character or brand.

AI output can be unexpected or inaccurate, so check anything you generate before you use it, especially before giving it to children.

You give us permission to store and process your prompts and images to run the Service, including sending them to the AI providers described in our Privacy Policy.

Sharing

If you turn on sharing for a book, anyone with the link can view it and download its PDF until you turn sharing off.

Prohibited uses

You may not use the Service or its content:

• to create or try to create content that sexualizes minors or is otherwise sexually explicit
• for any unlawful purpose, or to encourage others to act unlawfully
• to infringe our intellectual property or anyone else's copyright, trademark or privacy
• to harass, abuse, threaten, defame or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability
• to submit false or misleading information
• to collect or track the personal information of others
• to spam, phish, scrape or crawl without our permission
• to get around our credit limits, safety filters or security features

Requests may be blocked automatically, and we may suspend or close accounts that break these rules.

Third-party services and links

The Service relies on third-party providers, and the site may link to third-party websites. We don't control these and aren't responsible for their content, policies or practices. Please review their terms before using them.

Disclaimer of warranties and limitation of liability

Your use of the Service is at your own risk. To the extent the law allows, the Service is provided "as is" and "as available", without warranties or conditions of any kind, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, colorly.ai and our suppliers, service providers and licensors won't be liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue, lost data or replacement costs, however they arise, even if we were told they were possible. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.

Indemnification

To the extent the law allows, you agree to indemnify colorly.ai and our service providers and suppliers against any third-party claim, including reasonable legal fees, arising from your breach of these Terms, your use of generated images or your violation of any law or anyone's rights.

Severability

If any part of these Terms is found to be unlawful or unenforceable, it will be enforced as far as the law allows, and the rest of these Terms will still apply.

Termination

You can stop using the Service at any time, or ask us to close your account by emailing support@colorly.ai. If you break these Terms, or we reasonably suspect that you have, we may suspend or close your account without notice. Anything owed before then, by either of us, still stands.

Entire agreement

These Terms and the policies they refer to are the entire agreement between you and us about the Service, and replace any earlier versions. If we don't enforce a right, that doesn't waive it.

Governing law

These Terms are governed by the laws of Canada and the province where colorly.ai is based, unless the consumer protection laws where you live say otherwise.

Changes to these Terms

You can review the latest version on this page. We may update these Terms and will change the date above when we do. If a change is significant, we'll give reasonable notice. Continuing to use the Service after a change means you accept it.
